What is the validity of the certificate?
The Trademark Registration Certificate is valid for 10 years from the date of the initial application. It must be renewed every ten years to maintain continuous legal protection.
What is the Affidavit of Use (Year 5)?
This is a mandatory filing around the 5th year to prove to the Registry that the trademark is actively being used in commerce. Failure to file this can lead to the removal of your trademark.
Is the certificate physical or digital?
The Trademark Registry issues the certificate in a digital format (PDF). This digital copy is legally valid for all purposes, including legal proceedings.
